The dust has barely settled on Judge Robert Pitman's order enjoining enforcement of the Texas "heartbeat" bill, and it appears that even a temporary victory may be Pyrrhic. Setting aside the conservative nature of the Fifth Circuit, which will hear the state's appeal from his order, clinics are apparently afraid to begin doing abortions again. Even though no one can enforce the law, its prohibitions technically remain in effect. Clinics understandably fear that they can be sued later for what they do now, if/when Judge Pitman's order is overturned.
